TERMS & CONDITIONS

By visiting, purchasing a product from, or subscribing to Asian Language School Pty Ltd (hereby referred to as “ALS”), you agree, without qualification, to be bound by the terms and conditions (the “Terms”) of use set out below. 

Provision of the services

In providing the Services, we do not actively monitor the display, transmission and exchange of Material (defined below) that is accessible by means of the Services, nor do we maintain any obligation to do so except as otherwise determined by us or required by the laws of applicable jurisdictions. However, subject to the terms of our Privacy and Security Policy, we reserve the right to monitor the Services for purposes of determining that their usage is in compliance with these Terms and applicable laws. In addition, and as described elsewhere in these Terms, we maintain an absolute and unconditional right to review and remove material accessible by or transmitted through the Services that, in our sole discretion, we believe is in violation of the law of these Terms or is unacceptable to us in our sole discretion.

From time to time and without prior notice to you, we may change, expand and improve the Site and Services. We may also, at any time, cease to continue operating part or all of the Services or selectively disable certain aspects of the Services or portions of the Site. Any modification or elimination of the Services will be done in our sole and absolute discretion and without an ongoing obligation or liability to you, and your use of the Site and Services do not entitle you to the continued provision or availability of the Site and Services.

Your rights

ALS offers you a non-transferable, non-exclusive, limited right to access, use and display the content of this Site, provided that you comply with this Agreement and the Terms as set out in full. The materials of this Site are provided to you only for your private, non-commercial use. Certain services of this Site are available only to customers of ALS.

Use of the service

Your right to access and use our website and the Services is personal to you and is not transferable by you to any other person or entity. You are only entitled to access and use ALS website for lawful purposes.

You are responsible for maintaining the secrecy of your ALS account (the “Account”). You agree to notify ALS of any unauthorized use of your ALS Account. In order for the Service to function effectively, you must also keep your registration information up to date and accurate. If you do not do this, the accuracy and effectiveness of the Service to you will be affected.

Your access and use of ALS may be interrupted from time to time for any of several reasons, including, without limitation, the malfunction of equipment, periodic updating, maintenance or repair of ALS website or other actions that ALS, in its sole discretion, may elect to take. ALS is not responsible for any loss resulting from your using any of our services, software, materials, audio or video files, content, or communications. 

Intellectual property rights

All materials of ALS, including content, text, images, software, audio and video files, documentation, remain at all time the sole property of ALS or its suppliers. Such aforementioned materials are protected under international copyright, trademark and other intellectual property laws. You may not post, distribute, sublicense, translate or reproduce in any way any copyrighted materials, trademarks or other proprietary information without the prior express written consent of the ALS. 

Community forums, chats, message boards, and email conduct

You are solely responsible for the content of these messages as set out in this Agreement. You agree to not publish, contribute or post any material that:

• Contains content that is not original or for which you have not received the prior express written consent of the originator of said material.
• Contains objectionable language or is in any way profane, pornographic, sexually explicit, slanderous or libelous.
• Attempts to contact a fellow user of ALS without explicit solicitation by that user.
• Violates any viable rules, laws or regulations, or infringes on any rights of any third party.
• Contains viruses or any other code designed to interrupt, destroy or incapacitate the functionality of any software, hardware or telecommunications.
• Is considered “spamming,” such as chain letters, junk mail, or other solicitations.
• Attempts to impersonate another person or breach the security of ALS and its users.
• The opinions and messages posted by users at ALS do not reflect and are not representative of the views of ALS or its employees, affiliates, suppliers or partners. ALS is not responsible for the content of messages sent by users to other users they have located through ALS.
• ALS may remove any posted message at any time.

Fees and payments

By purchasing ALS services, you agree to be bound to the following terms:

ALS fees include any applicable taxes and any interest charged by the credit card or payment company, and exclude other fees associated with connecting to the Internet.

Payment you make will be transferred to a third party service provider and is secured.

You can always find current course prices posted in the checkout pages and in other pages of our website. Those courses must be used within specified number of days from the date of purchase. Unused portion will not be refunded.

All course fees are non-refundable and non-transferable.

Indemnification

You agree to indemnify, defend and hold harmless ALS and its affiliates, partners, suppliers, and employees from any and all liability, claims, costs, or damages arising from your use of the Site or your breach of this Agreement and any of the Terms set out herein. 

Informed consent for research

By enrolling in an ALS course, you and/or, if applicable, your parent or legal guardian on your behalf give consent to ALS to reproduce and use for language research purposes any material/information that you author or create during ALS courses or activities (for example, your course assignments). This includes use of the materials in their original and transcribed forms (‘Data’) by ALS in all media and for the full term of copyright in the Data. You understand that the Data will be held confidentially and will be anonymised, which means that your personal data such as your name and contact details will be removed from the Data before being used in ALS research, so that no one will be able to trace the Data back to you. Once the Data is anonymised it may be used in academic publications and presentations and in study, teaching and learning materials.

Personal data collected by ALS will be processed only for research purposes and shall be securely stored and deleted/destroyed after a period of 7 years from initial collection. Miscellaneous

If any portion of this Agreement is deemed unlawful, void or unenforceable by any arbitrator or court of competent jurisdiction, this Agreement as a whole shall not be deemed unlawful, void or unenforceable, but only that portion of this Agreement that is unlawful, void or unenforceable shall be stricken from this Agreement.

You agree that if ALS does not exercise or enforce any legal right or remedy which is contained in the Agreement (or which ALS has the benefit of under any applicable law), this will not be taken to be a formal waiver of ALS’s rights and that those rights or remedies will still be available to ALS.

All covenants, agreements, representations and warranties made in this Agreement shall survive your acceptance of this Agreement and the termination of this Agreement.

This Agreement represents the entire understanding and agreement between you and ALS regarding the subject matter of the same, and supersedes all other previous agreements.

Asian Language School Pty Ltd (“ALS”) is committed to protecting your privacy and ensuring you have a positive experience on our website and in using the information, tools, features and functionality located on our website (collectively “Services”). This policy covers the ALS website. This policy outlines our personal information handling practices for both online and offline data. If you give us personal information, we will treat it according to this policy. This policy may be updated from time to time and our website will indicate when the policy has been updated.

Uses of your personal information

When we ask information of you, our primary interest is to provide you with more personalised service. We respect your privacy and do not sell, rent or trade your name or personal details to other organisations.

We will use your Personal Information only in accordance with our Privacy Policy. If you do not wish us to continue using your Personal Information in this manner, you may request that your account be deactivated as specified below. Some of the ways we may use your Personal Information include:

Linked websites and third party services

Our website and services may provide links to other third-party websites and services which are outside our control and not covered by this policy. We partner with Stripe and Paypal to process payments from our customers. We also partner with Zoom to deliver the online classes. We encourage you to review the privacy policies posted on these sites you visit or services you use.

Security measures

The security of your personal information is important to us.

If you ever discover a fraudulent charge from ALS on your billing statement, please contact us and you must report it immediately to your credit card provider, in accordance with their standard procedures.

Only employees who need the information to perform a specific job are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.

Despite these security procedures and practices, as is the case with all computer networks connected to the Internet, ALS cannot guarantee the security of your personal information or any other information provided over the Internet and will not be responsible for breaches of security.

No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.

Communications from the site

As a customer of ALS, you will be added to our mailing list to receive occasional emails about service updates, special offers, and promotions from ALS.

You have the ability to unsubscribe from these emails at anytime, by simply clicking on the unsubscribe link included at the bottom of each email we send.

We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if our service is temporarily suspended for maintenance, we might send you an email.

Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account.

Minors

ALS website is not intended to be targeted to minors under applicable law and we do not intend to sell any of our Services to minors. However, we have no way of distinguishing the age of individuals who access our website and so we carry out the same Privacy Policy for individuals of all ages. If a minor has provided us with personal information without parental or guardian consent, the parent or guardian should contact us to remove the information.

Sharing your personal information

We do not sell or rent your Personal Information to third parties for marketing purposes.

We may share your Personal Information within ALS and with third party service providers for purposes of data processing or storage.

We may also share your Personal Information with business partners, service vendors, authorized third-party agents or contractors in order to provide a requested Service or transaction, including processing orders, processing credit card transactions, and providing customer support. We only provide these third parties with the minimum amount of Personal Information necessary to complete/utilize the requested Service or transaction, and the third parties are not permitted to use your Personal Information except for limited purpose of completing/providing the requested Service or transaction.

We may respond to subpoenas, court orders, or legal process by disclosing your Personal Information and other related information, if necessary. We also may choose to establish or exercise our legal rights or defend against legal claims.

We may collect and possibly share Personal Information and any other additional information available to us in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of ALS’s terms of service, or as otherwise required by law.

While navigating ALS’s website or Services you may be directed to content or functionality that is hosted by a third-party supplier. We encourage you to review the privacy policies posted on these sites you visit or services you use.

Quizzes and contests

We may provide you the opportunity to participate in quizzes or contests on our site. If you participate, we will request certain personally identifiable information from you. Participation in these quizzes and contests is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes contact information (such as name and email address), and demographic information (such as zip code).

We may use this information to personalize our communications to you and to suggest more relevant products and services.

Our website offers publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them.
